TERMS AND CONDITIONS OF SALE (CGV) - APIOBI

1. PURPOSE
  • The parties agree that orders placed on the seller's website via the Internet are governed exclusively by these general terms and conditions of sale.
  • The seller reserves the right to modify its conditions of sale at any time.
  • The applicable conditions will be those in force on the date of the buyer's order.
  • These terms and conditions shall prevail over any other terms and conditions not expressly approved by the seller.

2. DIGITAL CONTENT AND PRODUCTS

  • Digital content : Catalog of DIGITAL FILES and 3D MODELS for 3D printing, laser cutting and CNC machining, both free of charge and for a fee.
  • Physical products : Articles, equipment, accessories, materials delivered exclusively in metropolitan France.

4. SCOPE AND USE

These GTC apply exclusively to consumers (natural persons acting for non-professional purposes).

  • Personal use : All files and products are for personal use only.
  • Private use : All files and products are intended for private use only.
  • B2B ban: Purchase by professionals (companies, self-entrepreneurs, associations) for commercial or professional purposes is strictly forbidden. The Vendor reserves the right to cancel any order not complying with this condition. Any commercial exploitation, resale or distribution of digital files or objects derived from these files is strictly forbidden.
  • Large orders : The Seller reserves the right to cancel any order exceeding the normal needs of a consumer.
5. INTELLECTUAL PROPERTY AND PERSONAL AND PRIVATE USE LICENSE (UPPE)

5.1. Nature of the License : All 3D files (paid or free) available on the site https://apiobi.com are protected by copyright. The acquisition of a file confers on the buyer a Personal and Private Use Only License (UPPE). The seller remains the sole owner of the intellectual property rights to the original works.

5.2. Rights granted : The BUYER is authorized to :

  • Print 3D models in unlimited quantities for strictly personal and private use.
  • Share photographs of your impressions on social networks or websites, provided you mention the source (APIOBI).

5.3. Restrictions and prohibitions : In addition to the UPPE Exclusive Personal and Private Use License and under the terms of the license Creative Commons BY-NC-ND 4.0 (Attribution - Noncommercial - Nonmodification), it is strictly forbidden, regardless of how it is obtained (purchase or free download) :

  • Sales and Distribution : To sell, give, rent or share the digital file, even partially or modified.
  • Commercial use : To sell or commercially exploit the physical objects resulting from the printing of these files.
  • Modification : To modify, transform or adapt the 3D file for distribution or sale.

5.4. Penalties : Any violation of these clauses constitutes an act of counterfeiting within the meaning of the French Intellectual Property Code, and may give rise to legal proceedings.
License to use : The purchase confers a personal, non-transferable and non-exclusive right of use.

6. LIABILITY RELATED TO THE MANUFACTURE AND USE OF 3D MODELS

6.1. Distinguishing responsibilities : The Seller's liability differs according to the nature of the order (digital content or physical product).

6.2. Digital content and DIY projects : For 3D design files, whether used alone or as components of a project including other materials (e.g. PVC tubes, hardware), the BUYER alone assumes the quality of owner and manufacturer.

  • Assembly and third-party materials : The BUYER is responsible for the compatibility, strength and attachment of third-party components (tubes, adhesives, screws) to the printed element.
  • Structural safety : The Seller cannot be held responsible for damage resulting from incorrect assembly, faulty gluing or the use of materials that do not comply with the DIY project recommendations.

6.3. Physical products (manufactured by APIOBI) : For items sold already printed or manufactured by the Seller, the latter is responsible for the conformity of the product delivered.

  • Limited warranty : This liability is strictly limited to the normal use of the product. It does not cover breakage or accidents resulting from dropping, exposure to temperatures unsuitable for the material (e.g. deformation of the material in the sun) or modification of the item by the customer.

6.4. General exclusion : In all cases, the Seller declines all responsibility for personal injury or material damage resulting from improper, dangerous or non-conforming use of the objects (files or physical products).

7. PRICE AND PAYMENT
  • Price : Prices are indicated in Euros. Prices are net of VAT. VAT is not applicable, in accordance with article 293 B of the French General Tax Code. Due to this tax regime, no invoice with VAT recovery can be issued.
    APIOBI reserves the right to modify its prices at any time, the product being invoiced on the basis of the rate in force at the time the order is validated.
    Shipping costs for physical products are detailed before validation.
  • Payment : Secured via Stripe or PayPal. The order is firm upon confirmation of payment.

  • Security : Payments are made using SSL encryption. Bank details are transmitted directly to PayPal or Stripe. APIOBI does not act as a technical intermediary and never has access to your bank details.
  • Proof: The debit is immediate. The records of the payment systems are authoritative for financial transactions.
  • Restrictions: The customer must reside in a country covered by Stripe/PayPal. No business is conducted with countries under international sanctions.

  • Reservation of title : APIOBI retains full ownership of the physical products sold until full payment has been received, in principal, costs and taxes included.
8. DELIVERY AND LIABILITY
  • Digital Content : Immediate access via e-mail and customer account after payment.
  • Physical products : Delivery in mainland France.
  • Liability (Art. L221-15) : The Vendor is automatically responsible for the proper execution of the order until actual delivery to the customer. He can only be exonerated by proof of fault on the part of the customer, an unforeseeable act of a third party or force majeure.
    Force majeure : The responsibility of’APIOBI shall not be held liable in the event of non-performance or delay in performance of the contract due to force majeure, as defined by article 1218 of the French Civil Code (in particular: transport strikes, natural disasters, major computer or electrical network failures).
9. RIGHT OF WITHDRAWAL
  • Digital content : In accordance with article L221-28, 13° of the French Consumer Code, the right of withdrawal may not be exercised for the supply of digital content not provided on a physical medium, the performance of which has begun after the consumer's express prior agreement and express waiver of his right of withdrawal.
  • Physical products : Legal deadline of 14 days from receipt. Return in original condition at customer's expense.
  • Product condition : The right of withdrawal is a right of examination, not a right of use. In accordance with’Art. L221-23 of the French Consumer Code, If a product is returned, it must be suitable for resale in new condition.
    In the case of accessories in contact with liquids (fittings, strainers, sleeves), manufacturing tools, templates (e.g. spiral formation), molds, presses, the use of the product to make a creation or to use it according to its purpose constitutes a manipulation going beyond what is necessary to test the good. Any trace of use, however slight, rendering the product unfit for resale as “new” may result in refusal of the return or a discount of 50% to 100% of the product's value. The use of the right of withdrawal as a temporary rental service is not permitted by law.
10. LEGAL WARRANTIES

The customer benefits from the legal guarantee of conformity (Art. L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Art. 1641 of the French Civil Code).
Legal Warranty Information

  • The customer has a period of two (2) years from delivery of the goods to take action.
  • He may choose between repairing or replacing the good, subject to the cost conditions set out in article L.217-9 of the French Consumer Code.
  • The purchaser is exempt from having to prove the existence of a lack of conformity during the 24 months following delivery.
11. MEDIATION AND DISPUTES
  • Applicable law : French law. The French courts have exclusive jurisdiction.
